To file a writ of possession on a confession of judgment, file the Praecipe for possession upon a confessed judgment, and the notice 2973.1, .2, or.3 as required, and the writ.
Mortgage Foreclosure:
File the Praecipe and writ with the 3129 affidavit and act 91 certification, if applicable. Include the address or legal description of the property. The fee is $23.00.
Possession:
File the Praecipe and writ with the address or legal description of the property. The fee is 23.00.
Writ of revival:
File the Praecipe and writ of revival. The money amount must be the same or less than the original judgment. Include certification of addresses. The fee is $13.50, if amicable; $23.00, if adverse.
Indexed writ:
File a time-stamped copy of the writ with a raised seal from another county with the writ notice, major exemption, and claim for exemptions. The fee is $40.50. Include certification of addresses. The writ must be directed to the sheriff of Montgomery County.
With a garnishee, file interrogatories with an original signature and address of garnishee. The fee is $41.00.
